Terms and Conditions of Use - SharyDuck
Effective date: January 2026.
1. Purpose and status of the Service
The [Your Site] website (the "Site") is operated by [COMPANY NAME S.R.O.] ("SharyDuck").
SharyDuck is a technology platform (intermediary) that provides tools to coordinate and co-manage subscription costs.
IMPORTANT: SharyDuck is not a distributor of multimedia content, does not sell accounts, and does not provide access to streaming services.
SharyDuck just simplifies the cost-sharing process between individuals (Hosts and Subscribers).
Users recognize that any relationship with subscription providers is governed by their own policies.
These rules define the terms of use of the Site and the basic principles of service operation.
By using the Site, you agree to be bound by these terms and conditions.
2. Operator data (Compliance)
In accordance with Slovak law and Stripe requirements:

3. Relationships with third parties (Distributors)
Obligations of users
Users acknowledge that they are bound by the terms of use of third-party Distributors (Spotify, YouTube, etc.).
- The user is responsible for complying with the rules of the selected subscription service.
- SharyDuck does not change or control the rules of Distributors or influence their decisions.
Limitation of liability
SharyDuck is not responsible for any changes in Distributor policies or account blocking by Distributors due to violations of their policies.
4. Roles of the Parties and Payment Structure
4.1. Definition of Roles
The following roles are defined within the SharyDuck platform:
- Host — a registered user who holds a valid family subscription plan and offers co-sharing slots to Participants via the SharyDuck platform.
- Participant (Member) — a registered user who joins a Host's family group and pays for their subscription slot.
- SharyDuck — a technology intermediary platform that facilitates the agreement between Hosts and Participants and acts as a Payment Collection Agent on behalf of the Host.
4.2. Nature of the Transaction
When a Participant makes a payment (e.g. 3.40 EUR), the following legal relationship applies:
- The transaction is legally concluded between the Participant and the Host. The Participant pays the Host for the right to use a slot in the Host's family subscription.
- SharyDuck acts solely as an intermediary facilitating this agreement — it does not sell subscriptions and is not a party to the subscription contract between the Participant and the Host.
- By registering and creating a family on the SharyDuck platform, the Host authorises SharyDuck to collect payments from Participants on the Host's behalf.
4.3. Payment Agent and Fund Holding (Escrow)
SharyDuck is engaged by the Host as a Payment Collection Agent. This means:
- Funds paid by the Participant are received and temporarily held by Stripe (SharyDuck's licensed payment infrastructure provider) in a secure holding account — acting as a 'safe' — on behalf of the Host.
- These funds are considered the Host's property from the moment of Participant payment. They are held temporarily pending verification of service delivery (the protection period).
- SharyDuck deducts its service fee from the held amount before releasing the remainder to the Host's connected bank account via Stripe. The fee amount and schedule are displayed transparently before the Host activates a family.
- The Participant's payment obligation to the Host is fulfilled at the moment the payment is successfully processed by Stripe, regardless of the timing of the Host's payout.
4.4. Payment Security and Transparency
Security: All payments are processed through Stripe's secure infrastructure. SharyDuck does not store or process full bank card details. Stripe is a licensed payment institution regulated in the EU.
Transparency: The total cost (subscription share + SharyDuck service fee) is always displayed to the Participant before payment is confirmed. No hidden fees.
Statement Descriptor: Your card statement will show the transaction as SHARYDUCK.COM.
5. Cancellation Policy - Updated to 2026 Standards
One-click cancellation: You can cancel automatic subscription renewal at any time in your Account (My Subscriptions section). Validity period: When canceling, access is retained until the end of the current paid period, after which the charges will stop. Notifications: We send an email notification 3 days before the next automatic debit.
6. Refund Policy
Since SharyDuck acts as a Payment Collection Agent on behalf of the Host, any refund represents a release of funds temporarily held on behalf of the Host back to the Participant. The funds are not returned 'by SharyDuck' — they are returned to the Participant on behalf of the Host, in accordance with the following rules:
Full refund on behalf of the Host: If the Host has not provided access within 24 hours of payment, the temporarily held funds are released back to the Participant in full.
Pro-rata refund on behalf of the Host: If the subscription stopped working in the middle of the billing period due to reasons attributable to the Host, and the issue was not resolved within 48 hours, a proportional amount is released back to the Participant.
No refund: In accordance with section 7(6)(l) of the Slovak Consumer Protection Act, no refund is possible after access to digital content has been successfully provided and used by the Participant. The Host's funds are released to the Host after the protection period expires.
7. Responsibilities of the parties and verification (KYC)
Hosts guarantee that they are using personal (not commercial) family rates. SharyDuck has the right to request proof of subscription ownership. Subscribers undertake not to change passwords and data of other people's accounts. Violation leads to immediate blocking without refund.
8. Moderation and the Digital Services Act (DSA)
Ad moderation
SharyDuck moderates Host announcements.
We reserve the right to remove any offers that violate law or intellectual property rights.
Removal may be carried out on the basis of complaints from rights holders or other justified requests.
We may restrict access to certain materials or accounts to comply with legal requirements.
We are committed to complying with applicable EU requirements, including the Digital Services Act (DSA).

Complaints from rights holders
If you believe that content or an ad violates your rights, send a support ticket.
We will review the complaint and, if necessary, remove the material or restrict access to it.
In disputed cases, we may request additional information for verification.
Principles
We act in good faith and are committed to providing a safe and legitimate platform.
9. Dispute resolution and applicable law
Claims handling procedure
- The user undertakes to first contact support: support@m.sharyduck.com.
- These terms and conditions shall be governed by and construed in accordance with Slovak law.
- If the dispute is not resolved, EU consumers can use the ODR platform: https://ec.europa.eu/consumers/odr.
Pre-trial settlement
We recommend that all claims and support inquiries be directed to try to resolve the dispute before going to a third party.

10. Waiver of the right of withdrawal (withdrawal from the contract)
In accordance with Section 7(6)(l) of Slovak Act No. 102/2014 Coll. on Consumer Protection in Distance Selling (and equivalent EU directives), the User is informed that the right of withdrawal (withdrawal from the contract) cannot be exercised in relation to the provision of digital content or services if the performance has begun with the prior express consent of the consumer and the consumer's acknowledgement that he thereby loses his right of withdrawal. By using the Service immediately after payment, the User expressly waives his right of withdrawal.
11. Responsibilities of the Member
The member undertakes to:
- Use the Services in accordance with applicable laws and regulations.
- Do not violate the rights of third parties or public order.
Special Responsibilities of Hosts:
- Host warrants that it is the legal holder of the Subscription.
- Host undertakes to offer only those Subscriptions that allow the simultaneous connection of several users.
- Host guarantees that the Subscription is issued in Host's country of residence (or in the region specified in the offer).
Special Responsibilities of Subscribers:
- The Subscriber undertakes not to change any information relating to Host's Subscription (e.g. password, payment method).
- Subscriber agrees to use the Subscription only in the geographic area specified in the Distributor's terms and conditions.
12. Prohibited behavior
Strictly forbidden:
- Transfer stolen accounts or engage in fraud.
- Resell access to the Services or monetize Site data.
- Perform actions that interrupt the operation of the Site or damage it.
- Use the messaging system to spam, harass, or distribute illegal content.
13. Penalties for violations
In the event of a serious breach (e.g., fraud, invalid credentials, Host password changes), SharyDuck reserves the right to:
- Suspend or delete a User Account.
- SharyDuck has the right to withhold any funds located on the User's internal balance as compensation for damage to the platform and other users. The platform also reserves the right to seek damages in court.
14. Responsibility
- SharyDuck acts as a technology intermediary and Payment Collection Agent on behalf of the Host.
- SharyDuck is not a party to the subscription-sharing agreement between the Host and the Participant. The Host and Participant independently enter into a cost-sharing arrangement using SharyDuck's platform as a facilitating tool.
- SharyDuck is not responsible for the quality, availability, or content of third-party Distributor services (Spotify, YouTube, etc.).
- SharyDuck does not guarantee Hosts any specific volume of transactions or a minimum number of Participants.
- SharyDuck's liability in its capacity as Payment Collection Agent is limited to ensuring the secure receipt and timely transfer of funds in accordance with these Terms. Liability for service delivery lies with the Host.
- Overall liability is limited to direct damage proven by the User in connection with SharyDuck's own actions.
15. Personal data
SharyDuck processes personal data in accordance with the General Data Protection Regulation (GDPR). For more information, please see our Privacy Policy.
16. Force majeure
The Parties shall not be liable for any failure to fulfill their obligations due to force majeure (unforeseeable and insurmountable events), including strikes, epidemics or technical failures in the Internet.
17. Applicable law and jurisdiction
These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Slovak Republic.
18. Mediation and dispute resolution
In case of a dispute, the User should first contact SharyDuck's support team to find an amicable solution.
If an amicable solution is not found, the User (Consumer) has the right to initiate the Alternative Dispute Resolution (ADR) procedure at the Slovak Trade Inspectorate (Slovenská obchodná inšpekcia - SOI) registered at Prievozská 32, 827 99 Bratislava, or via the platform: https://www.soi.sk/en/Alternative-dispute-resolution.soi.
